Terms of Service

These Terms of Service ("Terms") govern your use of the OrderWitness platform operated by OrderWitness ("we", "our", or "us"). By creating an account or using our services, you agree to these Terms.

1. Description of Service

OrderWitness provides a software-as-a-service (SaaS) platform for e-commerce businesses to:

• Send order confirmation messages to customers via WhatsApp, email, or SMS
• Score orders for cash-on-delivery fraud risk
• Generate cryptographic evidence PDFs documenting customer responses
• Manage B2B quotations and milestone payments
• Integrate with e-commerce platforms (WooCommerce, Shopify) and Pakistani courier networks

2. Account Registration

You must provide accurate, complete information when registering. You are responsible for maintaining the security of your account credentials. You may not share your account with others or transfer it to another party without our written consent.

3. Acceptable Use

You agree not to use OrderWitness to:

• Send spam, unsolicited messages, or communications to people who have not placed an order with you
• Impersonate another business or create fraudulent order evidence
• Violate WhatsApp Business API or Meta Platform Terms
• Attempt to reverse-engineer, scrape, or abuse the platform's APIs
• Use the platform for any unlawful purpose under Pakistani or applicable law

4. Order Transaction Limits

Your subscription plan includes a monthly transaction limit (orders processed). If you exceed your limit, additional orders may be blocked until the next billing cycle or you upgrade your plan. We will notify you when you reach 80% of your monthly limit.

5. Payment and Billing

Paid plans are billed monthly or annually in advance. Prices are listed in PKR on our pricing page. We reserve the right to change pricing with 30 days' notice. Refunds are not provided for partial months unless required by law.

6. Evidence PDFs and Legal Use

Evidence PDFs generated by OrderWitness record customer confirmation responses with cryptographic integrity. While we design these documents to support dispute resolution with Pakistani couriers and marketplaces, we make no warranty that they will be accepted as legally binding evidence in any specific proceeding. Use of evidence PDFs in formal legal disputes is at your own discretion and risk.

7. WhatsApp and Third-Party Integrations

Your use of WhatsApp Business API through OrderWitness is subject to Meta's Platform Terms and WhatsApp Business Policy. OrderWitness is not responsible for message delivery failures, template rejections, or account suspensions by Meta. You are solely responsible for ensuring your WhatsApp messaging complies with applicable laws and platform policies.

8. Intellectual Property

The OrderWitness platform, its logo, and proprietary technology are owned by us. You retain ownership of your business data (orders, customers, products) uploaded to the platform. You grant us a limited licence to process your data to provide the service.

9. Data Processing

By using OrderWitness, you appoint us as a data processor for your customers' personal information. We process this data strictly to provide the confirmation and fraud prevention service. See our Privacy Policy for details.

10. Limitation of Liability

To the maximum extent permitted by law, OrderWitness is not liable for any indirect, incidental, special, or consequential damages, including lost revenue, lost data, or business interruption. Our total liability for any claim shall not exceed the fees you paid in the 3 months preceding the claim.

11. Termination

You may cancel your account at any time from your dashboard. We may suspend or terminate accounts that violate these Terms, with or without notice. On termination, you may export your data within 30 days; after that, data may be deleted.

12. Changes to These Terms

We may update these Terms. We will notify registered users by email at least 14 days before material changes take effect. Continued use after the effective date constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of Pakistan. Any disputes shall be resolved in the courts of Lahore, Pakistan, unless otherwise required by applicable consumer protection law.
